Terms and Conditions
DMV Epoxy Pro — Terms and Conditions for Concrete Floor Coatings
These Terms and Conditions apply to all services performed by DMV Epoxy Pro for the customer at the project location. By paying a deposit the Customer agrees to these terms.
1. Scope of Work
- Work includes only what is specifically described in the written estimate/proposal issued by DMV Epoxy Pro.
- Any additional work, upgrades, repairs, or services not included in the Estimate are excluded unless authorized via a written change order.
2. Payment Terms
- Deposit: A nonrefundable deposit of 30% of the total quoted price is required at booking to reserve scheduling, labor, and materials purchase.
- Final Payment: Full remaining balance is due upon completion of the job, unless otherwise stated in writing.
- Payment Methods: Credit card, debit card, cash, or check.
- Nonpayment / Collection: Failure to pay when due may result in collection actions. Customer acknowledges Contractor may pursue all legal remedies, including filing a lien to the extent allowed by law. Customer is responsible for reasonable collection costs and attorneys’ fees as stated below.
3. Scheduling, Rescheduling, and Cancellation
- Rescheduling: Must be requested no less than 72 hours before the scheduled service date. Rescheduling within 72 hours may be subject to a 10%, additional fee due to reserved labor and scheduling disruption.
- Cancellation: If Customer cancels after paying the nonrefundable deposit, the deposit is not returned, this cost covers our material purchases and preparation costs.
4. Access, Jobsite Requirements, and Customer Responsibilities
- Exclusive Use Required: DMV Epoxy Pro must have exclusive use and control of 100% of the floor area to be coated and adjacent areas necessary for prep, masking, and application.
- Customer Prep / Clear Work Area: Customer must remove vehicles, stored items, shelving contents, and all personal property from the work area unless the estimate explicitly includes item moving services. Delays caused by incomplete prep may result in additional charges or 10% rescheduling fees.
- Surface Condition: All surfaces must be clean, dry, and structurally sound on installation day, and free of active spalling, scaling, or delamination conditions that prevent proper bonding.
- Access + Storage: Customer shall grant free access for workers and vehicles and provide an area for storage/staging of materials and debris.
- Jobsite Security: Customer is responsible for securing entrances and preventing unauthorized access (including children, pets, visitors, other trades) during installation and curing.
5. Installation Realities and Limitations
- Airborne Debris: Contractor is not responsible for airborne contaminants and debris that settle into coatings due to conditions beyond our control (e.g., wind, HVAC airflow, open doors/windows, other trades).
- Customer-Caused Disturbances: Damage caused during installation or curing due to water leaks, customer-imposed debris, pets, foot traffic, or moving items/vehicles onto uncured coatings is the responsibility of customer. Any rework is an additional charge and must be agreed to in writing before performed.
- Appearance Variations: Color/finish may vary due to lighting, substrate porosity, patches/repairs, and normal product variation. Samples/photos are representative only.
7. Cure Times and Aftercare (Customer Responsibility)
- Customer must follow DMV Epoxy Pro’s aftercare instructions, including curing times, cleaning methods, and maintenance best practices.
- Minimum cure times may vary by system, temperature, humidity, and jobsite conditions. Unless otherwise stated:
- Light foot traffic: minimum 24 hours
- Heavy items: minimum 48 hours
- Vehicles: minimum 72 hours
- Customer acknowledges that entering, moving items back, or driving on the coating before the recommended cure period may cause damage. DMV Epoxy Pro will not be responsible for complimentary touch-ups or repairs caused by premature use.
- “Job completion” is defined as the moment DMV Epoxy Pro confirms work is finished and leaves the Jobsite.
8. Customer Approval of Coating Texture and Release of Liability (Slip/Fall)

Customer acknowledges and agrees that:
- Company is applying coating(s) selected by Customer and Customer acknowledges that the floor coating will change the texture of the floor;
- Company makes no representation as to whether or not the coating(s) make the floor surface more or less slippery;
- Customer accepts all liability related to slips or falls that may occur after the coating(s) are applied; and
- Customer is solely responsible for his/her choice of floor coating.
Assumption of Risk
Customer affirms that Customer has been thoroughly informed of and understands the risks associated with Customer’s choice of coating. Customer hereby voluntarily agrees to assume all risks and accept sole responsibility for any dissatisfaction with the texture of the final product or any injury (including, but not limited to, personal injury, disability, and death), that may occur, whether foreseen or unforeseen, in connection with Customer’s choice of coating.
Waiver of Liability
Customer hereby voluntarily releases and forever discharges and agrees to indemnify and hold harmless the Company, its directors, officers, employees, agents, contractors, and other workers, or their heirs and assigns (collectively, “Releasees”), from any and all liability, demands, causes of action, and responsibility for any loss, damage, or injury of any kind, arising out of or in any way connected with Customer’s choice of coating. Customer understands that all the statements made in this release are contractual and not merely recitals.
BY SUBMITTING A DEPOSIT, CUSTOMER HEREBY CERTIFIES AND AFFIRMS THAT CUSTOMER HAS CAREFULLY READ THE CONTENTS OF THIS RELEASE OF LIABILITY PRIOR TO SIGNING THIS AGREEMENT.
9. Warranty — Limited Lifetime (Non-Transferable)
DMV Epoxy Pro provides a Limited Lifetime Warranty to the original purchaser only and it is not transferable.
Warranty Exclusions / Not Covered
- Hairline cracks may reappear and are not covered.
- Future cracking from slab movement, settlement, heaving, or substrate instability is excluded.
- Proper cleaning using pH-neutral products is required.
- Harsh chemicals, abrasive pads, metal scrapers, and prolonged pooling water must be avoided.
- Damage due to negligence, abuse, misuse, or improper cleaning voids warranty.
- Any modifications or work done by other trades post-installation voids warranty for affected areas.
- Touch-ups, alterations, patching, or repairs performed by others are not covered.
- DMV Epoxy Pro is not responsible for floor damages caused by customer’s abuse, foundation defects, acid spills, industrial fluids, appearance due to structural changes to the concrete, fire, flood, or any Act of God.
Warranty Claim Process
- Customer must notify DMV Epoxy Pro in writing within a reasonable time of discovering an issue and provide photos and a description.
- Customer must allow access to the Jobsite for inspection and testing if needed.
- If the claim is approved, DMV Epoxy Pro’s responsibility is limited to repair/recoat of affected areas at DMV Epoxy Pro’s discretion. No cash refunds are guaranteed under warranty.
10. Photos / Video
Unless Customer opts out in writing before work begins, Customer grants DMV Epoxy Pro permission to capture photos/video of the work area for documentation, quality control, warranty records, and marketing (excluding personally identifying information where reasonably possible).
11. Disputes, Venue, and Attorneys’ Fees
- If a dispute cannot be amicably resolved, it shall be litigated, if at all, in a court of competent jurisdiction in Loudoun County, Virginia, and the parties waive objections to jurisdiction and venue there.
- If Contractor takes action to enforce these terms or collect monies owed, Contractor is entitled to recover costs and reasonable attorneys’ fees in addition to other remedies.
12. Limitation of Liability
To the extent permitted by law, DMV Epoxy Pro is not liable for indirect, incidental, special, or consequential damages (loss of use, lost profits, etc.). DMV Epoxy Pro’s total liability for any claim related to the project shall not exceed the amount paid to DMV Epoxy Pro for the services at issue.
13. Force Majeure
DMV Epoxy Pro is not responsible for delays or inability to perform due to events beyond our control, including weather, material shortages, manufacturer delays, power outages, unsafe conditions, or other unforeseen events.
14. Entire Agreement; Severability
These Terms, together with the estimate and any written change orders, constitute the entire agreement between the parties. If any provision is deemed unenforceable, the remaining provisions remain in effect.
